The Connecticut bishops’ sleight of hand...

The Connecticut Catholic Blogspot really hit the nail on the head: “The Bishops have made a heart-sickening sleight of hand. Claiming if they avert their eyes, then no evil is taking place.” 

And the sleight of hand continues. The November 2007 issue of the [Archdiocese of Hartford] Catholic Transcript contains numerous half-truths and rationalizations regarding the Plan B issue, including many false assurances that no evil has been committed.  

Let’s put these claims to the test. 

Claim #1 - That it is permissible to distribute Plan B, as long as there is moral uncertainty as to its effects: According to Msgr. David Liptak, “… if it is demonstrated with certainty [emphasis added] that the drug (drugs) used in Plan B effects an abortion, its (their) use cannot be morally justified.”[1]  Dr. John Haas, siding with the decision of the Connecticut bishops, stated, “You have to know what you’re doing and what is happening from your actions to be held morally culpable for them.”[2] 

Fact: In reality, even if there is doubt that Plan B may actually be an abortifacient, its use can never be justified. Father Christopher Kubat, M.D, a medical doctor turned Catholic priest and bioethics expert, who is also head of Catholic Charities in the diocese of Lincoln, [Nebraska], spoke against the use of Plan B in Catholic hospitals recalling the moral principle: "If there's doubt of fact, you don't act."[3]   

Arguing for a pharmacist’s right to refuse to dispense the morning after pill, Bishop Cristián Contreras of Chile said, "This is a matter of human life. Whenever there is a minimum doubt of the existence of human life the safest options must be taken".[4] 

Fr. Peter Fehlner, a Doctor of Sacred Theology, writes, "The fact is, if we have any doubt about whether a given action would directly risk someone's life, entail a violation of justice or threaten the salvation of a soul, we may not act on the basis of a scientific probability," he writes. "That means even if the pill in Plan B is only 'dubiously' abortive, we simply may not use it at all."[5] 

Msgr. William Smith, in his online course notes for the Moral Magisterium of John Paul II, states, “Thus, the two conventional maxims of traditional morality: (1) one can ALWAYS act on a certain conscience; (2) one should NEVER act on a doubtful conscience. What do you do with a doubt? The same thing one does in other practical areas of life: you get more information, you ask people who have lived well enough and long enough to know what they are talking about. Clearly, if the doubt involves a small matter, we have to make a little effort to resolve it; if it is a big matter or important value, we have to make a big effort to resolve the doubt and achieve the practical certitude we need to act on a certain conscience. These distinctions are reflected in the Catechism #1786-1751.”[6]  

Ignorance doesn’t always excuse. Contrary to the claim of Dr. Haas that you always have to know what you are doing to be morally responsible for it, the Church teaches that ignorance can be a sin.  It would be a sin for a person to be ignorant, that is, failing to be properly informed, either through negligence or malice. The Catechism of the Catholic Church gives an example of culpable ignorance: “For a bad effect to be imputable it must be foreseeable and the agent must have the possibility of avoiding it, as in the case of manslaughter caused by a drunken driver.” (Catechism, #1737) 

Or, in the case of a foreseeable abortion caused by giving Plan B to rape victims. 

And there is the classic example of a hunter shooting deer in the forest. If he hears a sound in the woods and he is going to shoot, he has to be clear as to the target because it could be another hunter making that sound. If he shoots, without knowing if it is a deer or a hunter, by intention he is committing murder because he was willing to take the chance of murdering a fellow hunter by not taking the extra step of identifying his target and verifying the outcome of his actions. 

So too, the Connecticut bishops were willing to take the chance with Plan B hoping it was not an abortifacient, even though a mistake on their part will mean the death of any newly conceived baby whose mother received Plan B in Connecticut Catholic hospitals. 

Claim #2: That it is uncertain whether Plan B is an abortifacient. 

Fact: Fr. Thomas Euteneuer, President of Human Life International, said it best: 

“The truth is that there is absolutely no doubt about how the Plan B pills work. Just ask the manufacturer, Barr Pharmaceuticals, whose product insert states: ‘This product works mainly by preventing ovulation (egg release). It may also prevent fertilization of a released egg (joining of sperm and egg) or attachment of a fertilized egg to the uterus (implantation).’ (My italics.) It's that third item that makes Plan B an abortion-causing drug. The same can be said for every chemical contraceptive.”[7] 

The Catholic Medical Association, the largest professional organization of Catholic physicians in the U.S., is opposed to Plan B: “Medical evidence demonstrates that the pregnancy tests used cannot accurately detect a pregnancy at fertilization but only after implantation which takes more than a week after the new life is formed.  At its Annual Meeting in 2003, the Catholic Medical Association passed a resolution correcting theologians who have erroneously suggested that it would be legitimate for Catholic hospitals to provide ‘emergency contraception’ to rape victims. Echoing the Vatican, the resolution stated that that the morning after pill ‘cannot be ethically employed by a Catholic physician or administered in a Catholic Hospital in cases of rape’. Dr. Chris Kahlenborn said bluntly, ‘The bishops who approve this are approving potential abortions.’"[8] 

A former high-ranking Vatican official and Chilean cardinal, Jorge Medina Estevez, stated that he had sent two letters to the Chilean government, containing scientific documentation that the "morning after pill" causes abortions and does not only operate as a contraceptive.[9] 

A federal court confirmed the right of Washington pharmacists to obey the conscience to refuse to distribute Plan B: “The court correctly held that the regulations force health care providers to ‘dispense a drug that ends a life as defined by their religious teachings.’ No health care professional should be forced to participate in destroying human life to preserve his or her professional license,” said Alliance Defense Fund senior counsel Gary McCaleb.[10]  So even a state court is sufficiently convinced that Plan B is an abortifacient, enough to rule in favor of those with religiously-held convictions against such drugs. 

Even the abortionists state that Plan B may prevent implantation of the baby embryo, which is an abortion. However, they have the false view that human life begins at implantation rather than conception, and so they vainly protest that Plan B does not cause an abortion. The abortionists have no doubt as to what Plan B can do:

Emergency Contraception (EC), also known as the “morning-after” pill, is simply a concentrated dose of ordinary birth-control pills that can substantially reduce a woman’s chance of becoming pregnant when taken within days of unprotected sex. EC does not cause abortion; rather it prevents pregnancy by inhibiting ovulation, fertilization, or implantation before a pregnancy occurs.”

Plan B works like a birth control pill to prevent pregnancy mainly by stopping the release of an egg from the ovary. It is possible that Plan B may also work by preventing fertilization of an egg (the uniting of sperm with the egg) or by preventing attachment (implantation) to the uterus (womb), which usually occurs beginning 7 days after release of an egg from the ovary. Plan B will not do anything to a fertilized egg already attached to the uterus. The pregnancy will continue.”

“If you have been raped, however, a Catholic hospital might be able to provide emergency contraceptive pills to help you prevent pregnancy. Directive 36 seems to allow providing emergency contraception to ‘a female who has been raped to defend herself against a potential conception from the sexual assault . . . if, after appropriate testing there is no indication she is pregnant.’ It does not say how to determine if conception has occurred and, since emergency contraception might sometimes prevent implantation of a fertilized egg (which happens after conception), Catholic hospitals still have to interpret the directives and decide if they can provide emergency contraceptive pills to a woman who has been raped.”

Claim #3: That it is not intrinsically evil to give contraception to rape victims. 

Fact: On September 17, 1983, Pope John Paul II told priests in Rome that “contraception is to be judged objectively so profoundly unlawful as never to be, for any reason, justified. To think or to say the contrary is equal to maintaining that, in human life, situations may arise in which it is lawful not to recognize God as God.”

The Catechism of the Catholic Church, promulgated by Pope John Paul II, states, “… ‘every action which, whether in anticipation of the conjugal act, or in its accomplishment, or in the development of its natural consequences, proposes, whether as an end or as a means, to render procreation impossible’ is intrinsically evil” (#2370).

On March 1, 1997, the Vatican Pontifical Council for the Family stated, "The Church has always taught the intrinsic evil of contraception, that is, of every marital act intentionally rendered unfruitful. This teaching is to be held as definitive and irreformable." (Vademecum for Confessors, #4)

Intrinsically evil means always and everywhere evil, regardless of intentions or circumstances.  Intrinsically evil actions “remain ‘irremediably’ evil acts; per se and in themselves they are not capable of being ordered to God and to the good of the person.” (Pope John Paul II, Veritatis Splendor, #81)   

Intentions that seem good to protect the welfare of an individual (i.e., compassion for a rape victim) would never justify performing an intrinsically evil act, such as contraception. This was clearly stated by Pope Paul VI in Humanae Vitae: “It is never lawful, even for the gravest reasons, to do evil that good may come of it (cf. Rom 3:8)—in other words, to intend directly something which of its very nature contradicts the moral order, and which must therefore be judged unworthy of man, even though the intention is to protect or promote the welfare of an individual, of a family or of society in general.” (Humanae Vitae, #14)

The Doctor of Theology, Fr. Peter Fehlner, states, “To accept the child conceived as a consequence of rape is simply a blessing as contrasted with the evil of attempting to prevent such a conception via the use of contraceptive medications, for all children are a blessing.”[12] 
 

Claim #4: That the Vatican has not given adequate guidance on this subject, and until this uncertainty is clarified, the distribution of Plan B in Catholic hospitals is morally permissible. 

Fact: If additional Vatican declarations are needed, here they are: On September 29, 2007, Pope Benedict XVI warned against dispensing drugs that have the goal of preventing the implantation of the human embryo: "It is not possible to anesthetize the conscience, for example, when it comes to molecules whose aim is to stop an embryo implanting or to cut short someone's life... I invite your federation [of pharmacists] to consider conscientious objection which is a right that must be recognized for your profession so you can avoid collaborating, directly or indirectly, in the supply of products which have clearly immoral aims, for example abortion or euthanasia..." 

In 2000, the Vatican Pontifical Council for the Family stated, “From the ethical standpoint the same absolute unlawfulness of abortifacient procedures also applies to distributing, prescribing and taking the morning-after pill. All who, whether sharing the intention or not, directly co-operate with this procedure, are also morally responsible for it."[13] 

On March 1, 1997, the Vatican Pontifical Council for the Family emphasized that contraception “denies the sovereign role of God in the transmission of human life.” (Vademecum for Confessors, #4).  

And the great encyclical by Pope Paul VI, Humanae Vitae, has for nearly forty years clearly taught the Church’s prohibition on contraception. Pope Paul VI emphasized that no one has unlimited dominion over their generative faculties: “just as man does not have unlimited dominion over his body in general, so also, with particular reason, he has no such dominion over his generative faculties as such, because of their intrinsic ordination towards raising up life, of which God is the principle.” (Humanae Vitae, #13). Also, Pope Paul VI stated that the prohibition against contraception applies in all scenarios, regardless of circumstances or intentions:  

"In conformity with these landmarks in the human and Christian vision of marriage, we must once again declare that the direct interruption of the generative process already begun, and, above all, directly willed and procured abortion, even if for therapeutic reasons, are to be absolutely excluded as licit means of regulating birth.
     "Equally to be excluded, as the teaching authority of the Church has frequently declared, is direct sterilization, whether perpetual or temporary, whether of the man or of the woman. Similarly excluded is every action which, either in anticipation of the conjugal act, or in its accomplishment, or in the development of its natural consequences, proposes, whether as an end or as a means, to render procreation impossible." (Humanae Vitae, #14)
 

Claim #5: That the Connecticut law mandating the distribution of Plan B is a “flawed law.” 

Fact: Actually, the Connecticut “law” mandating the distribution of Plan B is no law at all. As Pope John Paul II has clearly stated, “In the case of an intrinsically unjust law, such as a law permitting abortion or euthanasia, it is therefore never licit to obey it, or to ‘take part in a propaganda campaign in favor of such a law, or vote for it.’” And, "Abortion and euthanasia are thus crimes which no human law can claim to legitimize. There is no obligation in conscience to obey such laws; instead there is a grave and clear obligation to oppose them by conscientious objection."[14] 
 

Confusion, or disobedience to the Pope? 

The teaching of Humanae Vitae binds all persons, not just Catholics: Pope John Paul II, in his series of catecheses on Humanae Vitae, stated: “the norm of the encyclical concerns all men, insofar as it is a norm of the natural law and is based on conformity with human reason (when, it is understood, human reason is seeking truth).”[15] 

On September 17, 1983 Pope John Paul II stated that contraception is intrinsically evil due to the fact that when “couples remove from the exercise of their conjugal sexuality its potential creative capacity, they claim a power which belongs solely to God; the power to decide in a final analysis the coming into existence of a human person. They assume the qualification not of being cooperators in God’s creative power, but the ultimate depositories of the source of human life. In this perspective, contraception is to be judged objectively so profoundly unlawful as never to be, for any reason, justified. To think or to say the contrary is equal to maintaining that in human life situations may arise in which it’s lawful not to recognize God as God.”[16] 

It is not credible that the Connecticut bishops are in ignorance, either as to the Church’s clear prohibition against contraception, or the abortifacient nature of Plan B.  

What separates the Connecticut bishops from the Chilean bishops (who have rejected the morning after pill) is not knowledge, but willingness to obey the Pope and the magisterium. When bishops and theologians are using equivocal language and rationalizations in favor of committing intrinsically evil acts (i.e., abortion and contraception), we are no longer in the arena of innocent ignorance, but of deliberate obfuscation and deceit, which adds additional gravity to the crime.  

Contraception in Catholic hospitals is a contradiction in terms; to profess belief in the intrinsic evil of abortion and contraception on one hand and then come up with an exception to an “exceptionless” teaching, is a contradiction in terms.  

Pope John Paul II warned: “even within the Christian community, voices have been heard, and are still being heard, which cast doubt upon the very truth of the Church’s teaching. This teaching has been vigorously expressed by Vatican II, by the Encyclical Humanae Vitae, by the Apostolic Exhortation Familiaris Consortio and by the recent Instruction ‘The Gift of Life.’… The Church’s teaching on contraception does not belong to the category of matter open to free discussion among theologians.”[17]   

The devil’s calling card is moral ambiguity. According to Fr. Robert Carr, “one of the signs of the demonic is moral ambiguity. The light of reason turns dark and there is a loss of a sense of right and wrong.”[18] 

Regarding the Connecticut bishops, the word ‘deluded’ comes readily to mind, as does the story of The Emperor’s New Clothes.

On June 5, 1987, Pope John Paul II warned clergy and theologians of their grave obligation to faithfully transmit the Church’s teaching on contraception:  “A grave responsibility derives from this: those who place themselves in open conflict with the law of God, authentically taught by the Church, guide spouses along a false path. The Church’s teaching on contraception does not belong to the category of matter open to free discussion among theologians. Teaching the contrary amounts to leading the moral consciences of spouses into error.”

Asked what he would do if pushed on the issue by the state, Bishop Sheridan indicated that he would likely rather have the Church pull out of hospitals than compromise the faith.  "If I personally were being pushed on this and had to make the decision by myself, I'd have to question whether or not we could continue that particular ministry if the state were going to force us to act contrary to Catholic teaching, to the Catholic conscience," he told LifeSiteNews.com.

     Bishop Sheridan concluded, "How could you continue to call yourself Catholic if you were doing things that were contrary to Catholic teaching even if you were being forced by the state to do them?"
